Terms of Service
These Terms of Service govern the use of this website and bookings or purchases made through With Meraki Travel Collection, operated by Ampersand Design Think Lab Corp. (“we,” “us,” “our,” or the “Organizer”).
By using this website or completing a booking or purchase, you agree to these Terms together with the information, policies and any experience-specific conditions presented to you before purchase.
1. Our Experiences and Services
With Meraki Travel Collection design, curate, organize and/or facilitate travel experiences, activities, gatherings, journeys and related services.
Experiences may involve independent venues, guides, coaches, transport providers, accommodation providers, restaurants, artisans, practitioners, community hosts and other suppliers.
The relevant booking page will identify the principal details of the experience, including the date, price, inclusions, exclusions and material participation requirements.
2. Experience-Specific Terms
Different experiences may require different operating, cancellation, participation, transfer, safety or refund conditions.
Any experience-specific terms disclosed on the applicable booking page or otherwise provided before purchase form part of your booking agreement.
Where an experience-specific condition is more specific than these general Terms, the experience-specific condition will apply to that booking, subject to applicable law.
3. Booking and Confirmation
Unless expressly stated otherwise for a particular experience:

full payment is required to secure a place;
-
a booking is confirmed only once the required payment has been successfully received and confirmation has been issued; and
-
an inquiry, application, message, cart, unpaid checkout or expression of interest does not reserve capacity.
You are responsible for providing accurate contact and participant information so we can deliver booking confirmations and operational communications.
4. Prices, Inclusions and Exclusions
The price and inclusions applicable to your booking are those displayed on the relevant booking page at the time of purchase.
Anything not expressly identified as included remains the guest's responsibility.
Separate goods or services purchased directly from a venue, restaurant, transport provider or other third party may be subject to that provider's own terms.
5. Cancellations, Refunds and Transfers
Guest cancellation, booking transfer, date transfer, credit, late-arrival and no-show conditions may vary by experience.
The conditions disclosed for the applicable experience at the time of booking apply together with our Return and Refund Policy.
A restricted-refund or non-refundable condition relating to change of mind does not remove rights or remedies that cannot legally be excluded.
6. Changes, Postponement and Cancellation by the Organizer
We may make reasonable operational changes that do not materially reduce the experience purchased.
An experience may be postponed, modified, suspended or cancelled where reasonably necessary because of circumstances including:

safety considerations;
-
weather or environmental conditions;
-
access restrictions or closures;
-
government or authority restrictions;
-
minimum operating requirements;
-
venue, host or material supplier unavailability;
-
transport or operating disruption; or
-
other circumstances that prevent responsible delivery of the Experience.
Where an experience is materially changed, postponed or cancelled, the remedy applicable to that experience and our Return and Refund Policy will apply.
If we cancel an experience before it begins, we will apply the refund or alternative treatment disclosed for that experience. Where transfer, rescheduling or booking credit is offered, it may be offered as an option and will not replace a refund where a refund is otherwise legally due.
7. Weather, Operating Conditions and Safety
Travel and hosted experiences can be affected by conditions outside our direct control.
Ordinary conditions such as rain, traffic, heat, changing environmental conditions or other circumstances do not automatically cancel an experience where it can still be delivered safely and substantially as described.
Outdoor, marine, nature-based and other condition-dependent experiences may have specific operating parameters, alternative arrangements or safety triggers.
Guests must follow reasonable instructions from the Organizer and, where applicable, the venue, host, guide, coach, skipper, facilitator or relevant authority.
A guest may not require an experience to proceed contrary to a reasonable safety decision.
8. Participation, Health and Accessibility
Guests are responsible for considering whether an experience is suitable for their condition, ability and circumstances.
Where materially relevant, the applicable booking page will state participation requirements such as:

age restrictions;
-
physical demands;
-
mobility considerations;
-
swimming or other skill requirements;
-
dietary or allergy information;
-
clothing or equipment requirements; or
-
other eligibility or safety considerations.
Please contact us before booking where you require clarification regarding accessibility or participation requirements.
Requests for reasonable accessibility arrangements should be made as early as practicable. We will assess what can reasonably be accommodated within the nature and operating conditions of the Experience.
9. Guest Conduct
Guests must treat other guests, communities, hosts, staff, practitioners, cultural sites, equipment, natural environments and venues with reasonable care and respect.
Guests must comply with communicated access, conduct and safety requirements.
We may refuse or discontinue participation where a guest's conduct:

creates a material safety risk;
-
violates applicable laws or material venue or community protocols;
-
intentionally damages property or the environment; or
-
substantially disrupts the Experience for other participants.
Any refund treatment in these circumstances will be determined by the relevant experience terms and applicable law.
10. Third-Party Suppliers
We may work with independent suppliers and partners to deliver parts of an experience.
Relevant supplier, venue or operator requirements may apply where material to participation or delivery.
The use of third-party suppliers does not exclude responsibilities that applicable law places on us for the services we have agreed to provide.
Separate goods or services that you purchase directly from a third party are governed by your relationship with that provider.
11. Responsibility
We are responsible for the services we have agreed to provide and will address service failures where a reasonable remedy is available.
We are not responsible for loss arising from:

a guest's own acts or omissions;
-
failure to follow reasonable instructions;
-
inaccurate information provided by the guest; or
-
separate goods or services purchased independently from third parties.
Nothing in these Terms excludes or limits any right, remedy or liability that cannot lawfully be excluded or limited.
12. Force Majeure and Extraordinary Events
Where an experience cannot be delivered as planned because of an event beyond reasonable control, the applicable experience-specific cancellation, postponement or operating provisions will apply.
Any non-refundable or committed third-party cost that materially affects a guest's cancellation or refund entitlement should be disclosed before purchase where applicable and will not be introduced only after cancellation.
13. Booking Communications
Booking confirmation and other information may be delivered electronically using the contact information supplied at checkout.
Additional operational information may be provided closer to the Experience date, including meeting details, timing, what to bring, weather updates, access instructions and other information reasonably required for participation.
Guests are responsible for providing accurate contact information and reviewing communications relating to their booking.
14. Personal Information and Privacy
We may process personal information reasonably necessary to:

administer bookings;
-
communicate with guests;
-
process payments through applicable providers;
-
deliver Experiences;
-
coordinate relevant suppliers;
-
manage participation and safety where necessary;
-
provide customer service; and
-
meet applicable legal obligations.
Personal information is handled in accordance with our Privacy Policy and applicable law.
Completing a booking does not by itself constitute consent to unrelated marketing communications where separate consent is required.
15. Photography, Video and Media
Photography or recording may occur during some experiences.
Where identifiable images or recordings are intended for publication, communications or marketing, the applicable experience information, notice or consent process will govern their use.
Purchasing an experience does not by itself constitute blanket consent to unrestricted marketing use of a guest's image.
16. Intellectual Property
Unless otherwise stated, the website, written materials, original experience materials, graphics, photographs, designs and other content created or owned by With Meraki Travel Collection or Ampersand Design Think Lab Corp. may not be reproduced, commercially distributed or commercially used without permission.
Intellectual property belonging to independent artists, hosts, practitioners, photographers, venues, communities or other contributors remains the property of its respective owner.
17. Website Use
You agree not to use this website:

for unlawful or fraudulent purposes;

to interfere with the operation or security of the website;

to attempt unauthorized access to systems or information;

to transmit malicious code;
-
to submit intentionally false booking or payment information; or
-
to reproduce or commercially exploit website content without authorization.
We may restrict access where reasonably necessary to protect the website, customers or our operations.
18. Availability and Errors
We aim to present experience information, availability and pricing accurately.
If a genuine technical, pricing or availability error occurs, we may correct the error and contact affected customers before delivery of the experience.
Nothing in this section permits us to avoid obligations or remedies that apply under applicable law.
19. Complaints and Service Issues
Where practicable, guests should raise an issue during an experience so that an immediate remedy can be considered.

20. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without limiting mandatory consumer rights that may apply.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
21. Complete Booking Agreement
For a particular experience, the applicable agreement may include:

Experience-specific terms or participant requirements disclosed before purchase;

our Return and Refund Policy;

our Privacy Policy; and

the applicable order or booking confirmation.
